These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Emerging Apps Private Limited ("Company", "we", "us", or "our"), governing your use of the Dairibook mobile application ("App") and related services.
By downloading, installing, creating an account, or using the App in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the App and delete it from your device.
You must be at least 18 years of age to use Dairibook. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the App on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
To use Dairibook, you must create an account by providing your phone number. Authentication is performed via OTP (one-time password) sent via SMS or through Truecaller verification.

Dairibook is a record-keeping tool only. It does not provide accounting, tax, legal, or financial advice. You are solely responsible for the accuracy of the data you enter and for compliance with applicable tax and regulatory requirements.
Dairibook may offer free and paid subscription plans. Paid plans are billed on a monthly recurring basis.
Subscription payments are processed through UPI Autopay via Razorpay, our authorized payment gateway. By subscribing to a paid plan, you:
We reserve the right to modify subscription pricing at any time. We will provide you with at least 15 days' notice before any price increase takes effect. Your continued use of the paid service after the price change constitutes acceptance of the new pricing.
IMPORTANT: ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE.
Dairibook operates on a strict no-refund policy. Once a subscription payment has been processed via UPI Autopay, it cannot be reversed, refunded, or credited under any circumstances, including but not limited to:
Since Dairibook is a digital service delivered electronically and access is granted immediately upon payment, all sales are final. This is in accordance with the Consumer Protection (E-Commerce) Rules, 2020, which permit non-refundable digital goods and services where the consumer is clearly informed before purchase.
By subscribing, you expressly acknowledge and agree to this no-refund policy and waive any right to a chargeback, reversal, or refund of subscription fees already paid.
You may cancel your subscription at any time through the App settings or by contacting us at support@emergingapps.co.
Upon cancellation:
- Your subscription will remain active until the end of the current billing period you have already paid for.
- You will continue to have access to paid features until that billing period expires.
- After the billing period ends, your account will revert to the free plan (if available) or limited access.
- No prorated refunds will be issued for the remaining unused portion of any billing period.
Cancellation of your subscription will also revoke the UPI Autopay mandate, and no further automatic charges will be made. You may also revoke the UPI Autopay mandate directly through your UPI app or bank.
You agree to use Dairibook only for lawful purposes and in accordance with these Terms. You shall not:
The App, including but not limited to its source code, design, graphics, user interface, text, logos, trademarks, trade names ("Dairibook", "Emerging Apps"), and all related intellectual property, are the exclusive property of Emerging Apps Private Limited and are protected under applicable Indian and international intellectual property laws.
No part of the App may be copied, reproduced, modified, distributed, displayed, performed, or used in any manner without our prior written consent.
You retain ownership of the data and content you enter into the App (transaction records, business names, descriptions, etc.). By using the App, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of providing and improving our services.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Emerging Apps Private Limited, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, business opportunities, or other intangible losses, arising out of or in connection with your use of the App.

Our total aggregate liability to you for any and all claims arising from or related to these Terms or your use of the App shall not exceed the total amount you have paid to us in subscription fees during the six (6) months immediately preceding the event giving rise to the claim.
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

You agree to indemnify, defend, and hold harmless Emerging Apps Private Limited, its directors, officers, employees, agents, and affiliates from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with:

You may terminate your account at any time by cancelling your subscription and requesting account deletion by emailing support@emergingapps.co.
We reserve the right to suspend or terminate your account, at our sole discretion, without prior notice or liability, for any reason, including but not limited to:

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India. You irrevocably consent to the jurisdiction and venue of such courts and waive any objection as to inconvenient forum.
Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@emergingapps.co. We will attempt to resolve the dispute within 30 days. If the dispute cannot be resolved informally, either party may pursue legal remedies as provided in this section.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App, and supersede all prior agreements, representations, and understandings.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us to be effective.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms at any time without notice to you, including in connection with a merger, acquisition, or sale of assets.
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, wars, terrorism, riots, government actions, pandemics, power failures, internet or telecommunications failures, or acts of God.
We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. When we make changes:
